Terms and Conditions

Welcome to the "Giftit" platform.

Your use of Giftit - hereinafter referred to as "the Platform" - constitutes acceptance of these terms and conditions. Please read them carefully before using the application. We reserve the right to modify these terms at any time, and you will be notified of any material changes.

For the purposes of applying the terms and conditions, the following words and phrases - wherever they appear in the terms and conditions - shall have the meanings set forth opposite each of them unless the context requires otherwise:

• Platform: The "Giftit" electronic platform with its content and services that provides its users with the ability to send electronic gift cards provided by contracted partners.
• Store: The commercial entity registered in the application as a partner, licensed for trade, and contracted with by the Platform to market electronic gift cards to users.
• User/Users: Anyone who owns a personal account within the Platform, whether the Giver or the Recipient, for the purpose of benefiting from the services provided by the Platform.
• Giver: The user who purchases and sends the gift.
• Recipient: The person to whom the gift is sent.
• Registrant/Registrants: Refers to both the Store and User accounts simultaneously.
• Electronic Gift Card: An electronic gift card/voucher with a specified amount of goods purchased by the Giver from the Store to be sent to the Recipient and used within a specified period.
• Order: The process of purchasing a gift through the application.

• The user must be 18 years of age or older, and must independently fill in all correct data required for registration on the Platform in order to benefit from the services provided within the Platform.
• The information provided must be accurate, precise, complete and up-to-date. Please note that if incorrect data is entered, the Platform shall not bear any consequences resulting from this.
• The user alone is authorized to use their account after registration and activation on the Platform. They are prohibited from impersonating another person or sharing their personal account with others.
• You are responsible for maintaining the confidentiality of your account, password, order numbers, and verification codes that you receive via SMS messages.
• The Giftit platform confirms that there is no 100% secure platform on the internet. Therefore, it calls on its users to avoid sharing the platform with unknown parties or providing these parties with their data on the Platform, as there is no certain guarantee for data on the Internet.
• The user (Giver) must verify the information of the (Recipient) before completing and confirming the purchase process when sending a gift card. Please note that if incorrect data is entered, the Platform shall not bear any consequences resulting from this.
• The Recipient must use the gift card within its specified period. In case the specified period expires or the card is not used within the specified period, neither the Giver nor the Recipient has the right to claim a refund of its paid value.
• If the partner/store does not provide the paid service or product in the order as shown in the gift card, the user has the right to file a complaint with customer service on the Platform, and the Platform will be responsible for taking appropriate action with the service provider (Store) according to the agreement with them.
• It is strictly prohibited for users registered on the Platform to use it for the purpose of violating the laws and regulations of the Kingdom of Saudi Arabia.
• It is strictly prohibited to use the messaging feature or any of the Platform's services in any work that violates cybercrime regulations and the laws of the Kingdom of Saudi Arabia in general.
• The Giftit platform has the right to suspend or terminate your account in case of violation of any of these terms, and prevent access to the Platform, without giving any reasons or notifying you.
• Messages and notifications within the Platform, via the registered mobile number in the registrants' data, or via email upon registration on the Platform, are legally binding messages, and the registrant alone bears the responsibility for not reviewing them.
• The terms and conditions of the Platform have immediate effect. By downloading the Platform, registering on it, and activating your account, you are agreeing to them, and you will be notified of any modifications or material changes.
• By registering on the Platform, you agree to allow the Platform to send you promotional and marketing offers by any means the Platform wishes to communicate with you.
• The Arabic language in which the terms and conditions are written is the official version in case of any dispute or ambiguity when translated into English.

• The Giftit platform pledges to registrants within the Platform that all information and data will be accurate and secure, and pledges to correct and remedy any errors that may occur, God forbid.
• The privacy policy of the Platform includes all technical methods followed by the Platform to collect important data to protect the personal information of its registrants and benefit from it in complete confidentiality.
• The Platform pledges and commits to all its registrants to protect all their personal information. Please note that this data collection is specific to the Platform alone and cannot be shared with any external parties. The Platform also confirms that information is kept to the minimum necessary technically for protection purposes and to maintain the privacy of its users.

• When downloading the Platform and registering on it for the first time, the Platform will request the following personal information: (name, email, mobile number).
• Upon first registration, an activation message will be sent to the mobile number to avoid fraud, ensure no registration with fake accounts, and complete the registration process correctly and securely.
• When you start using the Platform, you will be asked to allow location access to determine the Recipient's city and display all stores or partners in that city. You can also disable location tracking on your mobile phone from the settings.
• The Platform saves all transaction data (purchases, payments) with all their details and invoices in a clear and visible record for the user.
• The Platform does not store information and data related to electronic payment during purchase. All payment steps are processed and verified through independent and accredited electronic payment gateways in the Kingdom of Saudi Arabia.
• The Platform allows partners and users to retain all data registered on it, and also allows them to modify it with limited permissions from their account settings when they wish.
• The Platform allows only its customer service to access some private information of registrants in order to serve them with high quality and professionalism. Communication records are also kept for evaluation, quality, and development purposes.
• The Platform sends files related to cookies to the registrant's device to identify it and its operating system to provide all appropriate technical services and also collect technical data (IP address, browser type, usage data).
• The Giftit platform pledges to maintain all private information of its registrants, and pledges not to modify or delete it except if one of them requests it due to a technical problem preventing modification.

• Information specific to registrants on the Platform that is requested from them is for the purpose of creating their accounts within the Platform, facilitating the purchase process successfully and reliably, and providing and improving services.
• Information is used for the purpose of processing and archiving all payments and transactions, and to enable registrants to make the most of their accounts and know all their previous operations.
• Registered information on the Platform is used to communicate with registrants in case of any technical or service problems.
• Information is used to verify the validity of registration and prevent any fraud or other technical threats.
• The Platform will share information specific to registrants within it without obtaining their consent with entities that may own the Platform in the future or when new partners enter, and the like, in complete confidentiality while pledging full commitment to registrants with all related regulations governing these operations.
• If the need or urgent necessity arises, the Platform will share the registered data or some of it with another party for any purpose as required, while pledging full compliance with the personal data protection system, its implementing regulations, and other related regulations.
• If a registrant wishes to delete their account within the Platform, they have the right to do so, unless there is a legal case preventing it. They can do this through the settings on their page, or by contacting customer service.
• The Platform shares information specific to registrants within the Platform when it receives an official request from official or judicial authorities in enforcement of the legislation and laws in force in the Kingdom of Saudi Arabia.

• We comply with security standards to protect your data.
• We do not sell your personal data to third parties.
• We retain your data throughout your use of the service and beyond in accordance with laws.

• Displayed prices include Value Added Tax (VAT) in accordance with the regulations of the Kingdom of Saudi Arabia.
• Payment is made through secure accredited electronic payment gateways within the Kingdom of Saudi Arabia.
• No amount is deducted except after confirmation of the purchase process.

In case of receipt, return and exchange, the Recipient must download the application and register with the number through which the gift card was received.

• The gift card validity period according to what is agreed upon with the store, provided it is not less than 14 days.
• If the Recipient does not receive the gift within the agreed period, for any reason, the amount will be returned to the Giver's wallet after deducting the service fee (electronic card and payment commission).

• First option: Choose an alternative product (exchange) from the same store with the same or lower value.
• Second option: Return the amount to the Recipient's wallet within the Platform (with the transaction commission deducted from the store).
• The Giver does not have the right to cancel the order after the gifting process. It is also necessary to verify the correctness of the Recipient's data before confirming the purchase process.
• The Recipient does not have the right to claim receipt of the gift in cash.
• The amount is not returned to the Recipient's wallet on the Platform except in the cases mentioned above.

• The Platform does not bear responsibility for any indirect or incidental damages, and our liability is limited to the transaction value or the amount paid.
• The Platform does not bear responsibility for store errors in execution, but will communicate with them and ensure they follow the contract terms outlined in the agreement with the Platform.
• The Platform does not bear responsibility for delays in any process due to circumstances beyond our control, such as network problems or technical services from external parties.

Registration and use of the Platform makes all parties - the Platform, partners, users whether Giver or Recipient - subject in their agreements to the laws and legislation of the Kingdom of Saudi Arabia in force therein, and that any disputes arising from these terms and conditions shall be resolved amicably first, and in case of disagreement, arbitration will take place in Dammam in accordance with the Saudi arbitration system.

The Platform does not bear responsibility for any failure in performance due to circumstances beyond its control, including natural disasters, civil unrest, power outages, and internet outages.

• The Platform has the right, as needed, to modify the terms and conditions of the Platform, and registrants will receive notification of such modification. Continued use of the Platform and not deleting your account is considered acceptance of the modification.
• By reading these terms and conditions and using the Platform, this constitutes consent and acknowledgment of all the terms and conditions in their entirety without addition, modification or cancellation.
